NIL, short for Name, Image, and Likeness, allows athletes to receive compensation for the commercial use of their identity, including their name, photos, videos, voice, and public persona (NCAA).

Our DMV NIL Approach
Backfield Media supports NIL opportunities that are built around real content, real storytelling, and real promotional value. NIL compensation should be connected to the athlete’s name, image, or likeness, not athletic performance, recruiting decisions, or pay-for-play arrangements (NCAA).

For Virginia athletes, state law protects student-athletes’ ability to earn NIL compensation and obtain professional representation, while also requiring athletes to disclose NIL agreements to their institution before execution. Virginia law also restricts NIL activity connected to certain industries, including alcohol, adult entertainment, cannabis, controlled substances, performance-enhancing drugs, tobacco, weapons, casinos, gambling, and sports betting.

For Maryland athletes, the Jordan McNair Safe and Fair Play Act prohibits public institutions of higher education from preventing student-athletes from earning compensation from the use of their name, image, or likeness. Maryland’s NIL framework also addresses student-athlete representation and restrictions on certain types of compensation from public institutions.

For Washington, D.C. athletes, D.C. law permits college athletes to receive NIL compensation, enter NIL agreements, participate in NIL activities, obtain NIL agent services, and participate in group licensing opportunities. D.C. law also includes disclosure requirements, agent rules, third-party restrictions, and limits on NIL activity connected to categories such as alcohol, tobacco, controlled substances, marijuana, steroids, sports betting, gambling, firearms, and adult entertainment.

School Logos, Uniforms, and Facilities
Backfield Media respects school, team, and athletic department intellectual property. In many cases, athletes may not use school logos, uniforms, facilities, apparel, equipment, trademarks, or other protected marks in paid NIL content unless the school gives permission.

Before producing paid NIL content, we recommend confirming whether school marks, uniforms, facilities, or team-related visuals can be used. When permission is not clear, Backfield Media can create clean personal-brand content without school trademarks.
